Over the course of my career as an estate planning attorney I have had unique insight into the many different kinds of trusts drafted by other law firms. Many new clients have approached my law firm to amend trusts drafted by other law firms. Most of these trusts are clunky and far more complicated they need to be. Almost all of the trusts this attorney has seen from other law firms are a mismatch for the clients estate. Law firm drafted trusts should be customized for the clients own unique situation.

Too many trusts which this attorney has reviewed from other law firms are what I label as “too much trust”, and by that I mean trusts that are loaded with content inappropriate for the clients estate. A living trust should be a perfect match for the clients estate profile. A trust should not be hampered with excessive language that is meaningless and will never come into play.

A law firm drafted trust should not be written in a way that tires out your client who is reading their trust. No less than an automobile does not need warmer seats, a living trust need not be laden down with provisions that are only appropriate for very wealthy estates.
